Unfinished Pool Construction/No Response

This was the second time we decided to use Cody Pools and we are now regretting our decision. We used the same Superintendent (Trey Pendleton) in both pool installations but we received very different results.

Prior to our third to last payment (almost full payment) we were promised they would fix the divots in the pebble tech at the bottom of our pool and in the hot tub area, clean our wrought iron fence which they sprayed with sundeck material, clean up the concrete stains all over the stone around the pool edge/hot tub, replace the hot tub filter cover because it’s already cracking (only 2 months old), fix the area where they messed up the concrete walkway and address the main waterfall spillover which is not functioning correctly. About ¼ of the spillway does not spill over correctly therefore you don’t get the nice even waterfall spillover appearance.

The first three months out of the last eight months, I attempted to have these issues addressed with my Superintended (Trey Pendleton) multiple times, at least 15 times or more. However, he always provided me with the same response “We will be out next week to fix all the issues” which that never happened and or he didn’t respond at all for weeks at a time.

I made one final attempt to contact my Superintendent about four months after they finished the pool and his response was “It's been a hectic couple of weeks trying to finish up some pools before the powers to be, shut down pool construction. We need to close out pools.” I get it, they need to close out pools so they get paid if construction is shut down.

It has taken them seven months to fix the majority of the issues addressed above and there is only one item which they still haven’t addressed. The spillover from the hot tub to the pool is still not functioning properly and ½ of the spillway is not flowing over properly. They sent the stone contractor out to sand down that area and it helped a little but it’s still not functioning properly. A second Superintendent (Hans) was assigned to address this issue because Trey Pendleton doesn’t know how to respond back to his customers. Hans come out and examined the spillover and determined the flow of water and or return to the hot tub wasn’t high enough. Which means, there isn’t enough water flow or pressure going back to the hot tub allowing for enough water to flow over the spillway correctly.

Two months have passed since Hans reviewed the last issue and still nothing has been done. I attempted to notify Hans and his boss (Daryl) via text message and they keep pawning it off to Try Pendleton to address. I contacted them (Hans and Daryl) one last time as of this past Monday (10/12/20) requesting an update and still nothing. Therefore, I informed them I will use the remaining $2,900 to have another pool company fix their mistake and if/what is left over I will pay them the remaining amount. Or, if it costs more than $2,900 to fix the issue, I will bill them for the difference.

On top of that, what drove me over the edge is when I called Cody pools back on 8/21 they informed me my warranty is no longer valid. Keep in mind, this was ONLY six months after filling my pool with water. They indicated it’s because I haven’t paid the final payment of $2,900. Which is true only because they haven’t addressed the final item with my pool. I refuse to make final payment until the work is complete.
